1. Acceptance of Terms
By accessing or using the FCC Intelligence platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and FCC Intelligence.
2. Definitions
- "Service" means the FCC Intelligence platform, including the website at fccintel.com, the application at app.fccintel.com, APIs, and all related services.
- "User," "you," or "your" refers to the individual or entity accessing or using the Service.
- "We," "us," or "our" refers to FCC Intelligence.
- "Content" means all data, text, analytics, reports, and other materials available through the Service.
- "FCC Data" means data sourced from the FCC Universal Licensing System (ULS) and other public FCC databases.
- "Derived Data" means analytics, scores, insights, and intelligence generated by our platform from FCC Data.
- "Subscription" means a paid plan that provides access to premium features of the Service.
3. Account Registration
To access certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized access or use
You must be at least 16 years of age to create an account. We reserve the right to refuse registration or terminate accounts at our discretion.
Each account is for a single user unless you have an Enterprise subscription that provides multi-seat access. Account sharing is not permitted.
4. Service Description
FCC Intelligence provides a data intelligence platform for FCC licensing information. Our Service includes:
- License data analytics: Searchable database of FCC license records with enriched metadata, entity resolution, and renewal intelligence.
- Renewal tracking: Monitoring of license expiration dates and renewal windows across entities and geographies.
- Entity profiles: Consolidated views of licensees with license portfolios, geographic footprints, and competitive context.
- Market intelligence: Geographic and sector analysis, competitive mapping, and trend data.
- API access: Programmatic access to our data and analytics (available on select plans).
- Export and reporting: Downloadable data exports and custom reports (subject to plan limitations).
We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice for material changes that affect paid subscriptions.
5. Subscriptions & Billing
Free Tier
The Explorer (free) tier provides limited access to the Service at no charge. Features and usage limits are subject to change. No payment information is required for the free tier.
Paid Subscriptions
Paid plans (Starter, Professional, Enterprise) provide enhanced features and higher usage limits. By subscribing to a paid plan, you agree to:
- Pay the applicable subscription fees as displayed at the time of purchase
- Provide valid payment information through our payment processor (Stripe)
- Authorize recurring charges at the start of each billing cycle (monthly or annual)
Billing and Renewal
- Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- We may adjust pricing with at least 30 days' notice before your next renewal. Continued use after a price change constitutes acceptance.
- All fees are exclusive of applicable taxes unless stated otherwise.
Cancellation and Refunds
- You may cancel your subscription at any time through your account settings or by contacting support.
- Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
- Refunds are handled on a case-by-case basis. Contact billing@fccintel.com within 14 days of a charge for refund requests.
- Annual subscriptions may be eligible for a prorated refund if cancelled within the first 30 days.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not:
- Use the Service to violate any applicable law or regulation
- Attempt to gain unauthorized access to any portion of the Service or its related systems
- Use automated tools to scrape, extract, or bulk-download data beyond what your plan permits
- Redistribute, resell, or sublicense Service data without authorization
- Interfere with or disrupt the integrity or performance of the Service
- Impersonate any person or entity or misrepresent your affiliation
- Use the Service data to harass, harm, or target any individual or organization
Violation of these terms may result in immediate suspension or termination of your account.
7. Intellectual Property
Our Intellectual Property
The Service, including its design, software, algorithms, entity resolution logic, renewal intelligence models, and Derived Data, is owned by FCC Intelligence and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary materials without written permission.
FCC Data
Raw FCC data is public information maintained by the Federal Communications Commission. We do not claim ownership of the underlying public records. Our intellectual property rights apply to the way we organize, enrich, analyze, and present this data.
Your Content
You retain ownership of any content you create within the Service (saved searches, notes, custom reports). By using the Service, you grant us a limited license to store and process this content to provide the Service to you.
Feedback
If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation to you. You grant us an unrestricted, irrevocable license to use and incorporate such feedback.
8. Data Accuracy & Disclaimers
While we strive for accuracy, you acknowledge and agree that:
- Our data is derived from public FCC records and may contain errors, omissions, or delays inherent in the source data.
- Our analytics, scores, and intelligence are algorithmic outputs and should not be the sole basis for business decisions.
- FCC data is updated periodically and may not reflect the most current licensing status. Always verify critical information directly with the FCC.
- The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. API Terms
If your subscription includes API access, the following additional terms apply:
- Rate limits: API calls are subject to rate limits based on your plan. Exceeding limits may result in throttling or temporary suspension.
- API keys: You are responsible for keeping your API keys confidential. Do not embed keys in public code repositories or client-side applications.
- Attribution: If you display our data publicly, you must include attribution to FCC Intelligence and note that the data is sourced from public FCC records.
- Caching: You may cache API responses for up to 24 hours unless otherwise specified. Permanent storage of bulk data requires written permission.
- Versioning: We may release new API versions and deprecate older ones with at least 90 days' notice.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FCC INTELLIGENCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, business opportunities, or goodwill arising from your use of or inability to use the Service
- Any damages resulting from reliance on data, analytics, or intelligence provided through the Service
- Any third-party claims arising from your use of Service data
Our total cumulative liability for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless FCC Intelligence and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of a third party
- Your use or misuse of FCC data obtained through the Service
13. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Grounds for termination include:
- Violation of these Terms or the Acceptable Use Policy
- Non-payment of subscription fees
- Requests by law enforcement or government agencies
- Extended periods of inactivity
- Conduct that we reasonably believe is harmful to other users or the Service
Upon termination, your right to use the Service ceases immediately. We may retain your data as required by law or for legitimate business purposes. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.
14. Dispute Resolution
Informal Resolution
Before filing a formal claim, you agree to contact us at legal@fccintel.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If informal resolution fails, any dispute arising from or relating to the Service or these Terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the state where FCC Intelligence is headquartered, or remotely as agreed by the parties.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
15. General Provisions
- Entire agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and FCC Intelligence.
- Severability: If any provision is found to be unenforceable, the remaining provisions remain in full force and effect.
- Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.
- Force majeure: We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control.
